Welcome to FixHub ("FixHub", "we", "us", or "our"), a bug and feature management platform provided by Kode Digital Sdn Bhd (Registration No. 202201015405 (1461102-X)), accessible through the FixHub website and related services (the "Service").
By creating an account, accessing, or using FixHub, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use the Service.
Please read these Terms carefully before creating or using a FixHub account.
1. Eligibility
You must be at least 16 years old, or the applicable age of digital consent in your jurisdiction if higher, to use FixHub.
By using the Service, you confirm that you meet this requirement and have the legal capacity to agree to these Terms.
2. The Service
FixHub helps individuals and teams report bugs, manage feature requests, organise testing sessions, assign work, collaborate on projects and track software development activities.
FixHub may provide free account access with certain usage limits. Additional capacity, features or account benefits may be made available through voluntary support contributions, subscriptions, promotional benefits, account plans or other offerings made available through the Service.
Projects shared with you or projects that you are invited to participate in may be subject to different account limits or access rules from projects that you own.
The availability, pricing, features, benefits and limits associated with any account type or offering will be displayed within the Service where applicable.
We may introduce, modify or discontinue plans, features, limits or parts of the Service from time to time. Where practical, reasonable notice may be provided for material changes.
We do not guarantee that FixHub will always be available, uninterrupted or error-free.
3. Your Account
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for activity carried out through your account.
- You agree to provide accurate information when creating an account and to keep relevant account information up to date.
- You must notify us promptly if you become aware of unauthorised access to or use of your account.
- You may not transfer, sell or provide your account credentials to another person in a way that violates these Terms.
4. Acceptable Use
FixHub is intended for genuine software development, issue tracking, testing and collaboration activities.
By using the Service, you agree that you will not:
- Use the Service for any unlawful purpose, including fraud, money laundering, illegal gambling operations or other activities prohibited in your jurisdiction.
- Sell, resell, rent, sublicense or otherwise commercially exploit access to FixHub accounts or credentials without our prior written permission.
- Attempt to circumvent account limits, usage safeguards, security measures, authorisation controls or access restrictions.
- Attempt to gain unauthorised access to another user's account, project, workspace or information.
- Upload, distribute or transmit malware, malicious code, spam or harmful material.
- Upload or submit content that infringes another person's intellectual property, confidentiality, privacy or other legal rights.
- Harass, threaten, abuse or deliberately harm another user.
- Use bots, scrapers or other automated systems in a manner that interferes with, overloads or degrades the Service.
- Misrepresent your identity or your affiliation with another person, company or organisation.
- Interfere with or attempt to disrupt FixHub's servers, infrastructure or security systems.
We reserve the right to restrict, suspend or terminate accounts that violate these Terms or create security, legal or operational risks for FixHub or its users.
5. User Content
You retain ownership of content you submit to FixHub, including bug reports, feature requests, project information, comments, descriptions, attachments and other materials.
By submitting content to FixHub, you grant us a limited, non-exclusive licence to host, store, process and display that content only as reasonably necessary to operate, maintain, secure and improve the Service.
You are responsible for ensuring that you have the necessary rights and permissions to submit any content that you upload or share through FixHub.
Content submitted to a shared project may be visible to other users who have authorised access to that project.
6. Voluntary Support Contributions
FixHub may allow users to make voluntary one-time support contributions through third-party payment providers such as PayPal.
Where clearly stated within the Service, a qualifying support contribution may provide additional account capacity, features or other benefits.
Any applicable benefit, condition or eligibility requirement will be displayed before or in connection with the contribution.
Benefits associated with future support contributions may be changed or discontinued from time to time.
Unless otherwise required by applicable law, completed voluntary support contributions are non-refundable.
Payment processing is handled by the applicable third-party payment provider and may also be subject to that provider's terms and policies.
7. Subscriptions
FixHub may offer recurring subscription plans that provide additional account capacity, functionality or other benefits while the subscription remains active.
The applicable subscription price, billing frequency, account benefits and usage limits will be displayed before you subscribe.
Recurring subscription payments may be processed through third-party payment providers such as PayPal.
By starting a recurring subscription, you authorise the applicable payment provider to process recurring payments according to the billing terms shown when you subscribe, until the subscription is cancelled or otherwise ends.
You may cancel an active subscription using the cancellation options made available through FixHub, the applicable payment provider, or other supported methods.
When a subscription ends, account benefits that depend specifically on the active subscription may also end. Benefits previously obtained through a separate qualifying one-time support contribution will not be removed solely because a recurring subscription is cancelled.
We may modify subscription offerings, pricing or included benefits. Changes affecting existing subscriptions will be handled in accordance with applicable law and payment-provider requirements.
8. Intellectual Property
The FixHub name, branding, design, application interface and underlying software are owned by or licensed to Kode Digital Sdn Bhd and are protected by applicable intellectual property laws.
Except where expressly permitted, you may not copy, reproduce, distribute, modify, sell or commercially exploit FixHub's proprietary materials without prior written permission.
9. Disclaimers
FixHub is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, to the maximum extent permitted by law.
This includes, without limitation, warranties of merchantability, fitness for a particular purpose, availability, reliability, security and non-infringement.
We do not guarantee any specific level of uptime, data retention, response time, availability or uninterrupted access to the Service unless expressly agreed otherwise.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Kode Digital Sdn Bhd shall not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, business, opportunities, goodwill or data arising from or relating to your use of, or inability to use, FixHub.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
11. Suspension and Termination
We may restrict, suspend or terminate your access to FixHub where reasonably necessary because of a violation of these Terms, security concerns, unlawful activity, misuse of the Service or operational requirements.
You may stop using FixHub at any time and, where available, may request or perform deletion of your account.
12. Changes to These Terms
We may update these Terms from time to time to reflect changes to FixHub, our business, applicable laws, payment arrangements, features or operational practices.
When these Terms are updated, the effective or last-updated date shown on this page will be revised.
Your continued use of FixHub after updated Terms become effective constitutes acceptance of the revised Terms where permitted by applicable law.
13. Governing Law
These Terms are governed by the laws of Malaysia, without regard to conflict-of-law principles.
